Welcome to Tide & Wave Wellness Co. (“Tide & Wave,” “we,” “our,” or “us”). By accessing our website, purchasing a membership or coaching session, booking a retreat or event, or participating in our services, you agree to these Terms & Conditions.
1. Services
Tide & Wave provides online Pilates and Yoga classes, movement coaching, wellness retreats, workshops, events, and related services. Services may be provided online or in person, depending on the offering.
2. Eligibility
Services are primarily intended for individuals 18 years of age or older. Participants under 18 may participate where permitted and with appropriate parent or guardian consent.
3. Bookings & Payments
All bookings are subject to availability. Prices are listed in Canadian dollars (CAD) unless otherwise stated. Payments may be processed through third-party platforms such as Wix, Stripe, or other payment providers.
By completing a purchase or booking, you authorize payment for the selected service and agree to the applicable terms, fees, and policies.
Where required, participants must complete any applicable waiver or consent form before participating.
4. Memberships
Move Well Memberships are subject to the membership terms displayed at the time of purchase, including the applicable free trial, recurring payment, cancellation, and class booking policies.
Memberships are for the individual who purchased them and may not be shared or transferred.
5. Cancellations, Rescheduling & Refunds
Cancellation and refund policies may vary depending on the service and will be provided at the time of booking or purchase.
For Move Well Memberships and Move Well Coaching, the applicable cancellation policies outlined in the relevant Plan Policies apply.
Retreats and special events may have separate cancellation, payment, transfer, and refund policies. These terms will be provided during registration and form part of your agreement with Tide & Wave.
No-shows and late cancellations may be subject to the applicable service policy.
Tide & Wave reserves the right to cancel or reschedule a class, event, or retreat due to circumstances including weather, venue availability, insufficient enrollment, instructor availability, or other unforeseen circumstances. Where applicable, we may offer a rescheduled date, credit, or refund in accordance with the specific service terms.
6. Health & Safety
Tide & Wave services are intended for general wellness and fitness purposes and are not a substitute for medical advice, diagnosis, or treatment.
You are responsible for determining whether participation is appropriate for you and for informing your instructor or coach of relevant injuries, physical limitations, allergies, or other concerns that may affect your participation.
If you have a medical condition, injury, or concern about participating in physical activity, we recommend consulting an appropriate healthcare professional before participating.
7. Assumption of Risk & Liability
Participation in Pilates, Yoga, movement coaching, retreats, travel activities, and other wellness activities involves inherent risks, including the risk of injury, illness, allergic reaction, property damage, or other loss.
By participating, you voluntarily assume these risks.
To the maximum extent permitted by applicable law, Tide & Wave Wellness Co., its instructors, coaches, contractors, partners, and representatives will not be liable for loss, injury, or damages arising from participation in our services, except where such liability cannot legally be excluded or limited.
Where a third party provides an activity or service as part of a retreat or event, that provider may have its own terms, waivers, and liability policies.
8. Participant Conduct
We are committed to creating a welcoming, respectful, and safe environment. Participants are expected to treat instructors, staff, other participants, venues, and community members respectfully.
Tide & Wave reserves the right to refuse or end participation without refund where conduct is unsafe, abusive, discriminatory, disruptive, or otherwise inappropriate.
9. Intellectual Property
All Tide & Wave content, including website text, branding, logos, graphics, photographs, videos, class materials, and other original content, is owned by or licensed to Tide & Wave Wellness Co.
You may not reproduce, distribute, modify, record, or use our content for commercial purposes without prior written permission.
10. Third-Party Services & Links
Tide & Wave may use third-party platforms and services, including booking, payment, video conferencing, email, analytics, accommodation, transportation, and activity providers.
We are not responsible for the independent policies, content, availability, or actions of third-party providers. Your use of third-party services may also be subject to their own terms and conditions.
11. Privacy
Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.
12. Changes to These Terms
We may update these Terms & Conditions from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms, to the extent permitted by law.
13. Governing Law
These Terms & Conditions are governed by the laws of Ontario, Canada, and applicable federal Canadian law.
